A BACCHUS MARSH man who allegedly fired four bullets into his wife’s car after she told him they were breaking up has been released on bail.
Marcus William Day, 34, appeared in the Ballarat Magistrates Court last Wednesday.
His application for bail was unopposed by the prosecution.
Last Monday, Detective Leading Senior Constable Lee Tabbitt gave evidence, saying the incident occurred after Day’s wife had told him their relationship was over.
Following a drunken argument, Day allegedly walked up to his wife’s car and fired four shots with a double barrel shot gun, two into the windscreen, one into a tyre and another into the driver’s side window.
Detective Tabbitt said that when Day was arrested, his speech appeared accelerated and he seemed to be under the influence of drugs or alcohol.
During that hearing, magistrate Peter Couzens said: “This is frightening behaviour involving the use of firearms … which one can only say was brought about in anger.”
On Wednesday, he acknowledged a change in Day’s attitude.
Day is facing three charges including using a firearm in a dangerous manner and criminal damage. He will appear again on August 28.
